In 2023, the Minnesota Legislature enacted the Minnesota 340B Covered Entity Report (Minnesota Statutes 62J.461)— legislation focused on understanding the net financial impact of the federal 340B Drug Pricing Program on participating health care organizations in Minnesota. Minnesota was the first state to establish reporting and findings from this nation-leading initiative provide much needed transparency to the 340B program.
Health care organizations that participate in the federal 340B Drug Pricing Program—known as covered entities—are required to annually report data related to their 340B prescription drug purchases and payments to the Minnesota Department of Health (MDH). MDH submits its findings to the Minnesota Legislature in annual reports each November.
